Kerchner v Obama - Summons & 2nd Amended Verified Complaint Delivered to Process Servers Yesterday - President's Day, February 16th, 2009

Hi All,

Just a quick announcement and update on the case. The wheels are in motion. The copies of the federal court Summons and 2nd Amended Verified Complaint were electronically delivered to professional legal process servers yesterday morning, President's Day, February 16th, 2009, for delivery to, and official serving on the Defendants. As my client Mr. Kerchner noted to me, an ironically befitting day and an interesting footnote for history in our goal to remove this usurper from the Oval Office.

Hello - I read it, and I understand most all of the allegations and such, but...

I don't get "where" this case is now? Will it actually be heard? I hope so.

Hi Loretta,

Per the post by Atty Apuzzo elsewhere in this blog, the Federal Court Summons and Complaint (lawsuit) was turned over to the process servers on President's Day and was served on the Defendants on the next day, 17 February, 2009. As I understand it, the defendants now have 60 days to respond. The other sides first step is likely a motion to dismiss, etc. And then Atty Apuzzo responds to that. Whatever happens at this stage, it will then be appealed to the 3rd Circuit appeals court. And then eventually to the U.S. Supreme Court. This will take time. The wheels of justice turn slowly sometimes, particularly when a defendant wants to stall to stay in power as long as they can. But turning the wheels are, and inexornably moving forward towards the goal, getting our Constitution and the rule of law back as to who is Article II eligible to be the President and CINC. The truth and our Constitution will evenually win out, imo. I am confident of that.
